On May 21, 2026, criticism arose over a proposal that could reward those involved in the January 6, 2021, insurrection at the U.S. Capitol with a $1.78 billion fund. This plan has been described as a “slush fund” by Democrats, who argue it would use taxpayer dollars to compensate individuals who have faced prosecution for their roles in the riot.
The riot resulted in injuries to 140 Capitol Police officers, with four officers dying. Among those involved was Ashli Babbitt, who was shot after breaking through a door window at the Capitol with intent to do harm. Babbitt had previously voted for Barack Obama and later became a supporter of the far-right conspiracy theory QAnon. On the first day of his second term, former President Donald Trump pardoned more than 1,500 people charged with crimes related to the January 6, 2021, riot. It is possible many of them could now receive compensation connected to their prosecutions.
Democrats have argued that Trump’s lawsuit against the federal government presents an obvious conflict of interest. On Monday, dozens of Democrats filed a motion to intervene in the case, describing Trump’s action as a “collusive lawsuit” that undermines the separation of powers.
“Trump’s action against the federal government he currently leads is a collusive lawsuit that undermines the separation of powers, frustrates Congress’ lawmaking prerogative and , unless rightfully dismissed for lack of subject matter jurisdiction , could siphon billions of taxpayer dollars into the pockets of those who sought to overturn the 2020 election,” they stated.
